kobe accuser & eagle colorado is a major issue

July 22, 2003-

District Attorney Mark Hurlbert is in a very sensitive situation. He was
appointed to his position several years ago by Governor Bill Owens. Mark
Hurlbert was appointed to the Office of District Attorney in the Fifth
Judicial District. Hurlbert filled a vacancy caused by the resignation of
District Attorney Michael Goodbee.

Governor Bill Owens was responsible for filling the district attorney
vacancy, because a sitting district attorney resigned before the elected
term had expired. The Governor appointment Mark Hurlbert and the term of
this appointment will be until the next general election in 2004. The
vacancy will then be filled by election.

In my opinion it would have been very difficult for DA Hurlbert not to have
filed charges on Kobe Bryant. I believe it would have been political
suicide. The sad thing about this whole situation is that Da Hurlbert now
must aggressively move forward in this very high profile case, and in the
process Kobe Bryant is virtually fighting for his life.

Two more rumors bite the dust

Two more reports regarding the Kobe Bryant case circulating among part of
the national media were debunked Monday.

Media reports that the 19-year-old woman who Bryant allegedly assaulted
received a ride home is not the case, sources said Monday. Reports that her
clothing was torn are also untrue, sources also.

Sources told the Daily that the alleged victim managed to get herself home
by 11:50 p.m., June 30, after ending the shift at the Lodge at Cordillera at
around 11:10 p.m.

They also said that while her clothing was disheveled and showed signs that
something had occurred, it wasn't torn or ripped, as some reports indicated.

"Some of the reports made it sound like something out of a bad movie," said
one source. "It wasn't like that."

The reports are part of a larger set of rumors and gossip that have been
circulating across the country about the case. Among them:

- That the alleged victim was in the room two hours. It was only about 20
minutes.

- When she came down, she was hysterical. She was not. Sources said she was
in a stupor and a state of shock.

- A few days before the incident, the alleged victim had accused another
hotel worker of sexual harassment, getting him fired. Not true, said the man
who was terminated. It was not the alleged victim.



Cameras in court

Eagle County Judge Fred Gannett ruled that not only is Bryant required to
appear at 4 p.m. Wednesday, he also ruled Monday that there will be cameras
in the courtroom.

Gannett denied a motion by Bryant's attorneys asking Gannett to reconsider
an earlier order allowing one video camera and one still camera in the
courtroom while Bryant is advised of the charges against him, and also
advised of his rights.

The mystery girl says she lives in Orange County , California, however I
don't believe this is true. In one of my future emails, you'll see she told
me she lived in " La Brea, California. " I had to tell her there was no
such city called " La Brea, California. " I told her " La Brea " was a
street in Los Angeles and not the name of a city.

Towards the end of this email the mystery girl says,

" I'm a sociology major with an emphasis on CRIMINOLOGY and DEVIANT
BEHAVIOR."

During the preliminary hearing we were told that Kobe Bryant told the
accuser to " Kiss his penis " after they had sex. It was further reported
that the accuser said " No " , and Kobe Bryant physically held the accuser's
head down and made her kiss his penis . Didn't this sound kind of weird to
you? This just didn't sound like something Kobe Bryant would do, nor did it
fit the flow of the accuser's story. This sounded like some type of "
Deviant sexual behavior " that was made up. Remember the mystery girl said
her college studies had an emphasis on " Deviant behavior. " Is it possible
that this story was made up by the accuser from some of her studies of "
Deviant behavior " in college, and she wanted to make the story more
credible and believable ? It would be very interesting to check the
accuser's college courses to see if she is taking these classes. If she is,
the investigators should check with her instructor and other students to see
if this type of deviant behavior " Kiss the penis " was discussed in class
or contained in any of the books. I just find this to be more than a
coincident. You will see in some of the future emails that the mystery
girls prides herself about how crafty the accuser is.

So how about the presumption of innocence?

Just remember one thing.. The DA took a long time to figure out that
he wanted to go ahead with the case. People have said that the
collective jury's "Jaws will drop with the overwhelming evidence"...
Answer then this riddle..If it was so overwhelming evidence why did it
take 2+ weeks of deliberation for the DA to decide to go ahead with
the charges??

I doubt the DA 's case is as water tight as he would like. Each and
every day the accuser's ingetrity is getting eroded away what with
trying to commit suicide twice in the last 5 months I personally would
not want her on the witness stand.

"I was listening to the radio at work (Sean Hannity) and some guy called
and said he's a friend of someone who went to school with the girl that
was supposedly raped, the guy sent Sean an e-mail with a link to a Vail
Colorado newspaper, apparently there was a story in the paper that said
the paper was trying to get records unsealed, the caller said that the
records that are currently sealed are 2 cases where this girl accused 2
other men of raping her.
Sean was able to get the reporter on the air (didn't catch his name),
the reporter basically said that there have been allegations made by
this woman 2 other times that turned out to be false and the newspaper
in Vail was trying to unseal these documents, they're currently fighting
it in court now.
Also another interesting note, another caller called up and said 5 days
before the incident occured a male employee was fired because the same
woman went to management and accused him of sexual harassment.
Sean is suppose to talk about the Kobe Bryant case on Hannity and Colmes
so this issue should be brought up and he'll mention the reporters name

The news media has held back the name of 19-year-old Katelyn Kristine Faber,
for months. After NBA star Kobe Bryant was formally charged with Class 3
felony sexual assault, it was assumed that there would be a presumption of
innocence for Bryant, and an expectation of anonymity for the alleged
victim.

Tom Leykis, host of a syndicated radio talk-show has been publicly stating
her name on the air for days. "We're told that rape is violence, not sex,
and if that's true there's no reason she should feel shame or
embarrassment," Leykis said, adding that he felt that it was unfair to name
Bryant but not his accuser. More recently, The Globe has identified the
accuser.

Despite Leykis' take on the matter, rape is a serious and traumatic crime
that makes the victim feel ashamed and withdrawn. For those with the
courage to come forward, anonymity is often sought as a means for the victim
to privately start the heeling process with close friends and family.

In this case, more than a dozen of the American Idol reject's 'friends' have
come forward to discuss the matter and their alleged conversations with the
accuser. In just the past week alone, Lindsey McKinney, 18, Ashley Scriver,
19, Sara Lombardi, 17, Rachel Yandle, Janelle Medina, 19, Casey Strickler,
Sharon Smith, 17, Tyson Ivie, 18, Brigitte Lowry, Sara Dabner, 17, Josh
Putnam, Stephanie Morris, 17, Steve Evancho, and Luke Bray, have all had
their fifteen minutes of fame to discuss the various aspects of the case -
and many have corroborated facts that are not necessarily complimentary to
the accuser.

According to a July 22nd NBC report, the alleged 'rape victim' was at a
party last week - three days before Kobe Bryant was formerly charged -
"bragging" about the incident, and even gave a graphic description of
Bryant's anatomy to the astonishment of five witnesses. University of
Northern Colorado campus police were called when she overdosed on February
25th, and was taken to the hospital. UNC Police Chief Terry Urista said "An
officer determined she was a danger to herself," he said. "It's classified
as a mental health issue." The Orange County Register also reported that
she had overdosed on drugs - again - a few weeks before the alleged sexual
assault. This has also been corroborated by several of her friends.

While one friend said she thought "it was just a cry for help," others
explained the accuser's bizarre behavior on being distraught over a
tumultuous breakup with a boyfriend and the death of her best friend in an
automobile accident. Regardless, it does nothing to add to the woman's
credibility - nor does her recent conduct provide her any exceptional rights
to anonymity.

David Silber, a George Washington University psychologist, says many false
accusations of rape occur "when there's loneliness, a need for attention, or
a need to feel important." Studies also show that the problem of false
reporting is more pervasive than many might think. The Institute for
Psychological Therapies cites a Purdue University study that concluded that
"false rape allegations constitute 41 percent of the total forcible rape
cases reported."

Seeming to enjoy the limelight, the young Eagle County District Attorney,
Mark Hurlbert, was 'unavoidable for comment' in the days following his
charges against Bryant. Hurlbert had recently dropped several other
credible sexual assault cases. Since the latest round of news on Bryant's
accuser surfaced, he has been uncharacteristically mute, other than to
assert that the 'victim' is "strong," and won't buckle under media and
defense pressure. It would appear she buckled long ago, and its just a
matter of time before further embarrassment is brought to the people of
Eagle County, Colorado.

groupie. Several major publications said the accuser was well known
among NBA players as a groupie. Her family were season ticket holders
for the Denver Nuggets Pro basketball team. There were even

was the same person that said a Utah Jazz player raped her when she
was 17 years old. However, she settled out of court and the her
records were sealed because she was a minor. At this point this is
unconfirmed and only a rumor. I heard Deshaun Stevenson of the Utah
Jazz might have been the player. Once again, this is only a rumor,
and nothing has been confirmed. Does anyone have more information
about the Deshaun Stevenson case ? Or if in fact Deshaun Stevenson was
the Utah Jazz player that was involved in a sex controversy? If you

Governor Bill Owens was responsible for filling the district attorney vacancy, because a sitting district attorney resigned before the elected term had expired. The Governor appointment Mark Hurlbert and the term of this appointment will be until the next general election in 2004. The vacancy will then be filled by election.

In my opinion it would have been very difficult for DA Hurlbert not to have filed charges on Kobe Bryant. I believe it would have been political suicide. The sad thing about this whole situation is that Da Hurlbert now must aggressively move forward in this very high profile case, and in the process Kobe Bryant is virtually fighting for his life.

Two more rumors bite the dust

Two more reports regarding the Kobe Bryant case circulating among part of the national media were debunked Monday.

Media reports that the 19-year-old woman who Bryant allegedly assaulted received a ride home is not the case, sources said Monday. Reports that her clothing was torn are also untrue, sources also.

Sources told the Daily that the alleged victim managed to get herself home by 11:50 p.m., June 30, after ending the shift at the Lodge at Cordillera at around 11:10 p.m.

They also said that while her clothing was disheveled and showed signs that something had occurred, it wasn't torn or ripped, as some reports indicated.

"Some of the reports made it sound like something out of a bad movie," said one source. "It wasn't like that."

The reports are part of a larger set of rumors and gossip that have been circulating across the country about the case. Among them:

- That the alleged victim was in the room two hours. It was only about 20 minutes.

- When she came down, she was hysterical. She was not. Sources said she was in a stupor and a state of shock.

- A few days before the incident, the alleged victim had accused another hotel worker of sexual harassment, getting him fired. Not true, said the man who was terminated. It was not the alleged victim.



Cameras in court

Eagle County Judge Fred Gannett ruled that not only is Bryant required to appear at 4 p.m. Wednesday, he also ruled Monday that there will be cameras in the courtroom.

Gannett denied a motion by Bryant's attorneys asking Gannett to reconsider an earlier order allowing one video camera and one still camera in the courtroom while Bryant is advised of the charges against him, and also advised of his rights.

The mystery girl says she lives in Orange County , California, however I don't believe this is true. In one of my future emails, you'll see she told me she lived in " La Brea, California. " I had to tell her there was no such city called " La Brea, California. " I told her " La Brea " was a street in Los Angeles and not the name of a city.

Towards the end of this email the mystery girl says,

" I'm a sociology major with an emphasis on CRIMINOLOGY and DEVIANT BEHAVIOR."

During the preliminary hearing we were told that Kobe Bryant told the accuser to " Kiss his penis " after they had sex. It was further reported that the accuser said " No " , and Kobe Bryant physically held the accuser's head down and made her kiss his penis . Didn't this sound kind of weird to you? This just didn't sound like something Kobe Bryant would do, nor did it fit the flow of the accuser's story. This sounded like some type of " Deviant sexual behavior " that was made up. Remember the mystery girl said her college studies had an emphasis on " Deviant behavior. " Is it possible that this story was made up by the accuser from some of her studies of " Deviant behavior " in college, and she wanted to make the story more credible and believable ? It would be very interesting to check the accuser's college courses to see if she is taking these classes. If she is, the investigators should check with her instructor and other students to see if this type of deviant behavior " Kiss the penis " was discussed in class or contained in any of the books. I just find this to be more than a coincident. You will see in some of the future emails that the mystery girls prides herself about how crafty the accuser is.

So how about the presumption of innocence?

Nobody's saying "lock him up before we see the evidence."

The fact is that there's only one person who's seen all the evidence who
is supposed to be objective and has made any sort of legitimate public
statement, and that's the DA.
I'm not trying to say that the DA's decision means Kobe is guilty.
Obviously, innocent people are charged with crimes all too often.
Nevertheless, before you call the girl a lying, golddigging whore it is
worth remembering that there was one objective person, who saw all the
evidence, who decided that Kobe needed to go to trial.

Just remember one thing.. The DA took a long time to figure out that
he wanted to go ahead with the case. People have said that the
collective jury's "Jaws will drop with the overwhelming evidence"...
Answer then this riddle..If it was so overwhelming evidence why did it
take 2+ weeks of deliberation for the DA to decide to go ahead with
the charges??

I doubt the DA 's case is as water tight as he would like. Each and
every day the accuser's ingetrity is getting eroded away what with
trying to commit suicide twice in the last 5 months I personally would
not want her on the witness stand.

DB is in the Kobe's BB here.
This newbie is coming along. Has a good frame of mind but needs to adjust and navigate the functionaliities on the BB. I'm still learning each day after one month here. It's okay to make mistakes; that's how people learn more in life. Perhaps DB might wanna try to use "wraparound text" in his wordprocessor before importing his cut and paste. Also, it's perfectly acceptable to use "edit" key at the lower right hand corner of your post to make revisions.

yeah, the damn seniors here in Fla are fipping out and cutting up their AARP cards... they are also marching in protests..... as far as DB, I think he clipped what he wanted and ran.

Is DB Still Around?

Cliff notes and then some?
Yesterday I had posted a response to one of DB's other repeats he submitted in the Jacko BB for which another moderator had deleted two of DB's thread in entirety along with my replies. But the gist was that DB had "cut and pasted" many disjointed issues all over the place with nearly 30 URL websites and seemed directionless, 27 of which are active.

Perhaps DB might be kind enough to provide his commentary and analysis about the issues raised to help focus our understanding of what he's conveying here on the BB. And Last I thought I can keep up with most here. :angryfire
