There's a lot of controversy in my area over a proposed bylaw that makes landlords responsible for growops in houses they own and rent out? They can be fined huge amounts of money.

Is this fair? Should they be responsible for what their tenants do?

As a property owner, FUCK NO! If I don't have the right to do random searches in their homes, then I shouldn't be responsible for what my tenants do there!

I don't like it anytime when a higher up is blamed for something that someone below has done (like Bush and the scandal with the mistreatment of Iraqi prisoners). This might just be because I was in a leadership position at my military school for the past 3 years and there's really no reason why you should be blamed if something went wrong because of intelligence or something that is the fault of those underneathe you.

I will have to give the ghetto-man 100% agreeance on this one. When I am Juan's landlord, I do NOT want to be charged with his marijuana field in my backyard, or his mexican alien-smuggling ring that has a storage basement in my house! :happycow: :wiggle:

Well, I totally agree with you all. I have had tenants before and the laws are quite strict as to not invading their privacy and I have to give X amount of notice before entering the premises, etc. Someone could totally have a grow op and hide it from me. I don't think it's fair to be held responsible at all.

A tenant who is living underneath an owner of a propoerty, or property management is responsible for their own stuff. Any DAMAGE caused by the tenant is assumed responsibility of the tenant.

If a Landlord/property management company/owner has reasonable suspicion, they can give a NOTICE to enter the property with reason to inspect the living conditions to ensure it meets health codes and regulations. This is just a snaeky way to walk in and take a look. At NO POINT can the owner of the property touch or move any personal belongings which the tenant has.

If a VISUAL inspection of the area is not sufficient for the owner, the only other choice is obtaining a search warrant which has to be proven with reasonable cause.

This is about the best an owner can do legally. Anything else past what I just said is considered Trespassing, Invasion of Personal Privacy, or even Intrusion.

And i agree that they shouldn't be held responsible just because they are talking marijuana....does that include meth labs? What about when someone murders someone in their apartment? Rapes? Beats their kids/wives? It's bloody ridiculous...
