So what else is new? We all sorta knew that. This is the dumbest asswipe case for Kobe to face Kate's flimsy accusal of rape, facing 25 years to life. What a joke! If he get's convicted; the Appeals lawyers are going to have a field day demostrating "reversible error." and Kobe will restore his freedom. For Joe Blow, ya can stay in jail for being poor. Judge Gannett is another political hack.

He wrote his opinion from the bench placating both sides, then finding sufficient probable cause for the Kobe case to proceed into trial. He also knows that Prosecution's case is weak, very weak - maybe even less than a coin toss. He still rules Kobe has to camp out at Eagle, Colorado for the next year. The Kobe case wouldn't find the DAs time of day had it been Kobe Jones, Kobe Beef or Kobe Nobody. Kobe is treated unfairly because he's a rich black celebrity. Kate's football team and entire High School mates never would face such charges. Kate was passed around more times than the number of cards in the deck.

$$$$$$ Great for the local economy ya know. $$$$$ Tourism will record boom past the normal 1.2 million folks that visit the surrounding area. It's the next best thing since Camp OJ almost ten years ago. Judge Gannett goes down in history now. For a preliminary hearing, he didn't need to write a written opinion. Just the fall of the gavel would have done it. (Remember Judge Kathleen Kennedy at OJ's PH?) He wants his written decision published and floated for the world to see. What a panty waste. :hass: The next trial judge will get his/her fame too. Everyone seeking own 15 minutes. Next Gannet, local sheriffs, detectives, journalists and Kobe watchers are going to write another 100 books on "How to do 52 pick-ups and not get sued." :cop:

District Judge Terry Ruckriegle dismissed all potential witnesses home for the day and said he wanted to hear from the defense — in his chamber. The outcome of the arguments could play a pivitol role in the case either for or against the Kobe : Mackey wants to use the details to suggest the woman had mental problems that could have clouded her perception of what happened between the two in a Colorado hotel room last June . Kobe Bryant's attorneys and prosecutors in the sexual-assault case against him swapped arguments Thursday over whether the medical records of his 19-year-old accuser should be kept secret. A motions hearing in the case is scheduled for today in Eagle. Pamela Mackey, an attorney for the Los Angeles Lakers guard, asserted that the Eagle woman waived her right to secrecy of her medical records by discussing her alleged suicide attempts with others, including a sheriff's detective. "The evidence to be elicited at this hearing will show that the information contained in the subpoenaed records was discussed by the (woman) with a number of third parties," Mackey wrote in a motion released Thursday. "These conversations constitute an implicit waiver of the physician-patient privilege protecting the medical information."

Prosecutors, however, said previous court rulings hold the secrecy privilege - especially in emotionally sensitive sexual-assault cases - can be intentionally waived only by the patient. Even accidental revelations or testimony in court would not lift that secrecy, according to those rulings. "The victim had not waived her privilege either by having a third party present during the communication, by the communication not in the course of treatment or by a communication to someone not covered in the statute, and that the defendant (is) not entitled to access the records," said Assistant District Attorney Ingrid Bakke , quoting a 1993 ruling by the Colorado Court of Appeals.

At issue today are defense subpoenas of medical records from the Eagle Valley Medical Center, the Northern Colorado Medical Center and the University of Northern Colorado police and the campus health services center surrounding two alleged suicide attempts by the woman. The defense wants to call into question the woman's credibility by raising the alleged suicide attempts - including one documented incident in February when she was held by police in Greeley as a danger to herself - and her purported use of psyc hiatric drugs.

Mackey argued, in a motion released this week, that the woman falsely reported a sexual assault by Bryant as an attention-getting ploy toward her former boyfriend, following the same pattern of her suicide attempts. District Court Judge Terry Ruckriegle will decide whether to allow any information about her medical history to be admitted into a trial.

Since the medical records are evidence which speak the truth, they are private up to the point of filing a criminal charge. Once an accuser goes public, the person's history "fell out of privilege," it's like the horses are out of the barn. Kinda hard to squeeze back the toothpaste. Pamela Mackey gathered nine witnesses including family and friends of the alleged victim, waiting out in the hall-ways of the court house yesterday in making her proffer. Kobe's lawyers were prepared to argue that the 19-year-old woman waived her doctor-patient privilege by disclosing her medical history. They argued Kate suffered a medical condition known as "diarrhea of the mouth" with a load of "implicit waivers" that allows Kobe's lawyers to argue Kate as an "attention seeker" who resorts to drastic measures when spurned — including two reported suicide attempts in February and May 2003. Funny, how none of the prosecution or TV analysts EVER once explained the following state of Kate's mind for the charges against Kobe: 1. How three rehabs in 2003 are irrelevant to the accuser's June mental instability condition during the middle of the year. Two before (Feb and May) and one after (Oct,) only months apart. The health insurance record of claims are in the database. 2. Why Kate's long lists of drug intake days before have no relevance for Kobe in confronting the contemporaneous charges. The local pharmacy business records are in the database. 3. How medical records and the psychological archives documented her medical recovery or absence of mental diagnoses have no value to corroborate or refute her rape claims. The health insurance claims are in the database. 4. What Kate's history of suicide attempts have in not destroying self and Kobe's career. The hospital records and local ambulance records exists to document the accuser's fragile state of mind. 5. What Kate told her family members and her friends about Kobe are facts that reveal Kate's mental condition and issues surrounding that relationship. They all heard it from the horse's mouth. So how loaded up with legal or illegal substance was the state of Kate's mind at the time of her allegation? The defense showed the evidence existed but what is the irrelevance of documents and testimonies to seek the truth of Kate's credibility for her rape claims? Did she or didn't she say "no?" Does Kate EVEN KNOW while under anti-psychotic medication, fantasizing in meeting Kobe all day long? So where is the "Kobe beef" in preventing the evidence and testimonies in speaking the truth?
