computer / burning problem

ok so I borrowed a game off a friend that requires the cd to play it. Problem is nero wouldn't let me burn the program disc, it kept saying "unrecoverable read error" so I just copied all the data off the cd and burned it as a data disc. Now Everything on the cd works, it autoruns the program menu, hell I even reinstalled the game off my burnt disc but when I go to play it just says "insert the correct cd"

So what is different about this? Is there a program I can use to burn the program cd to work? Am I missing a simple setting? Can I go into the game files and override something to tell it to read off the cd? Next question, the cd is pretty scratched is that why nero is having trouble reading it or is it some copyrighted thingy?
