Of course for the more affluent with second homes there. But the media population are those working to cater to the wealthy who vacation there at Eagle County. Despite vacation homes above median average, the per capita income reflects those and not much lower income housing or minorities. Read the flimsy drafted legal complaint from the Hillbillies wanna be big time prosecutors. At the next trial level after the Preliminary Hearing, State District Judge Terry Ruckriegle urged attorneys to make sealed filings "sparingly and wisely" and he chided the prosecution for citing "no legal authority" to seal all details of evidence.

Anyways, I would like to stray from all the name calling and verbal abuse that you seem to have taken to and simply state a pschological fact and see what you all think. Thus, let us return to the mainstream of this symposium, that is namely the article and namely this quote that follows:

One of my majors is psychology, and one of the things we must always look out for are leading questions and things of that nature. First let me tell you about some research by Frederic Bartlett and then I will tell you about the research of Elizabeth Loftus.

A popular word to describe an aspect of memory is that of forgetting but with study of memory we find that there is no such thing a forgetting only a failure to retreive. But I digress. We go momentarily to the recreations of Bartletts experiment and then to Bartletts discovery. Many studies have been done showing in many contexts that memory is strongly affected by an individuals framework. Thus, elements that fit neatly within the framework were easily remembered; elements that were somewhat at odds with the framework were distorted in memory or omitted; and elements that were absent but typically present in events of that type were added to the event in memory. That is to say for example, people were told a story in which a person's visit to the dentist was decribed. They were later asked to recall what they had been told. MANY PARTICIPANTS FALSELY REMEMBERED HEARING ABOUT THE PATIENT CHECKING IN WITH THE RECEPTIONISTAND LOOKING AT A MAGAZINE WHILE IN THE WAITING ROOM, EVEN THOUGH THESE DETAILS WERE NOT MENTIONED IN THE ORIGINAL ACCOUNT. Another example includes students who were waiting in a professors office and seconds after leaving it were asked to recall the contents of the office. Many students "remembered" seeing a books in the office even though there were none. This happenes because they are in line with the subjects' expectation of what "should" be in the office.

So, simply stated, we can force ourselves to sort of believe what we want to.

Now, from the aformentioned we can state that our memory can often "trick" us if you will. So that is what Bartlett found. Loftus is doing research with pertinance to Kobe, namely that of these false memories (that, by the way, these people will swear are absolutely true). We must now know that eyewitness and victims alike have memory errors, what then should we believe?? This is where the quote comes into play (sorry about the length but im comming full circle). Loftus research states that jurors and judges should pay attention to HOW the memory evidence was collected and HOW the victim was questioned. She did one experiment where she showed people a video tape of a car accident. Immediately afterwards some were asked "Did you see THE broken headlight?" and others were asked "Did you see A broken headlight?" This small difference in wording had a large impact, and participants questioned about "the headlight" were much more likely to report having seen one than subjects asked about "a headlight," whether the film showed a headlight or not. The same happened in a study where some were shown a video and asked if they "saw the bus in the background" or if they "saw a bus in the background." The results were the same.

Now that we see that memories can be implanted simply by wording questions a certain way does anybody else see the problem with this quote:

"It was her mother that knew right away what happened," Bray said. It was her mother, Bray said, who told the woman, "You were raped."

Kate never said she was raped, the mother implanted this false memory into her. She created a memory error but she thinks it is completely true. Tell me what you think.
